Services offered include, but are not limited to, wood fence installation, vinyl fence installation, chain link fence installation, aluminum fence installation, privacy fence installation, fence repair, custom fence design, pool fence installation, automatic gate installation, ornamental iron fence installation, security fence installation, fence staining and sealing, and fence replacement.
The scope, materials, and pricing for any specific project are defined in a written estimate or contract agreed upon by both parties before work begins. We reserve the right to decline a project at our discretion.
All estimates are based on information available at the time of the on-site visit and are valid for 30 days from the date issued unless otherwise stated in writing. Estimates are not binding contracts.
Final pricing is confirmed in a written contract signed by both parties. Prices may change if the scope of work changes, if unforeseen site conditions are discovered after work begins (such as buried obstructions, underground utilities, or soil conditions that require additional materials or labor), or if material costs change materially between the estimate and installation date.
Any changes to the agreed scope of work must be authorized in writing by both parties before additional work is performed. We will notify you of any potential cost changes before proceeding with out-of-scope work.
Project start dates are scheduled after a signed contract and deposit are received. Scheduling is subject to crew availability and permit approval timelines. We will communicate expected start windows and notify you of any delays.
If you need to reschedule, please notify us at least 48 hours before the scheduled start date. We will make reasonable efforts to accommodate your request. Cancellations made less than 48 hours before a scheduled start date may result in forfeiture of the deposit.
We reserve the right to reschedule work due to weather conditions, permit delays, or other circumstances beyond our control. We will notify you as soon as possible and work with you to find the next available date.
Payment terms are specified in your written contract. In general, a deposit is required to secure your project on the schedule. The remaining balance is due upon project completion unless otherwise agreed in writing.
We accept payment by check, cash, or other methods specified at the time of contract. Late payments may be subject to a late fee as described in the project contract. We reserve the right to suspend or withhold work if payment obligations are not met.
In the event of non-payment, we reserve the right to pursue all legal remedies available, including filing a mechanic's lien on the property in accordance with California law.
Where required by local ordinance, we will apply for and obtain the necessary building permits on your behalf as part of the agreed project scope. Permit fees are the responsibility of the Customer and will be included in the written contract or invoiced separately.
You are responsible for confirming that your project complies with any applicable homeowners association (HOA) rules before work begins. We can advise on common requirements, but HOA approval is your responsibility. We are not liable for delays or additional costs caused by HOA rejection of approved designs.
Before work begins, you agree to:
We are not responsible for damage to unmarked underground lines, sprinkler systems, or other features not disclosed prior to work beginning.
We stand behind our workmanship. Any workmanship warranty applicable to your project will be stated in your written contract. Warranty coverage does not apply to damage caused by acts of nature, accidents, vandalism, improper use, or modifications made by parties other than us after project completion.
Materials and products installed are subject to manufacturer warranties, where applicable. We will assist you in understanding those warranties, but we do not extend manufacturer warranty terms.
Except as expressly stated in your project contract, all services are provided "as is" without additional warranty, express or implied.
To the fullest extent permitted by applicable law, PV Sunnyvale Fence Builder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from a project shall not exceed the total amount you paid to us for that specific project. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.
If a dispute arises between you and PV Sunnyvale Fence Builder, we encourage you to contact us first so we can try to resolve the issue directly. Most concerns can be addressed quickly through a direct conversation.
If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. Any dispute that proceeds to formal legal proceedings shall be resolved in the courts of Santa Clara County, California, and both parties consent to the personal jurisdiction of those courts.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any legal action or proceeding relating to these terms shall be brought exclusively in the state or federal courts located in Santa Clara County, California.
